Is this a gambling site?

We are not a gambling site as we are considered a game of skill (see definition below). Gambling is defined at a state level and almost always requires three elements to be present 1)award of a prize, 2)contest or game based on chance, 3) consideration. If any of these elements are not present then the activity would not be considered gambling. The contest/game is a skill based game and therefore the basis of chance has been eliminated.

Location Verification.

Before a withdrawal of credits can be requested for cash, identification must be submitted showing the location of your residency. In addition to this documentation we use tracking methods to verify location.

Patton Designs / SportofKings.US ™ assumes no responsibility for the actions by you, the Player. You acknowledge that the contest offered by Patton Designs / SportofKings.US ™ may be deemed an illegal activity in certain jurisdictions, and represent that you have made a reasonable inquiry into the legality of participating in Patton Designs / SportofKings.US ™ contest wherein you play. You acknowledge that Patton Designs / SportofKings.US ™ is unable to determine where its Software is being used, and that Patton Designs / SportofKings.US ™ is therefore relying upon your representation and express acceptance of this restriction by clicking where indicated, and that you will only use the Software for fantasy tournament contest play in those locations where it is legal to do so.

1.2 Entire Agreement
The terms and conditions herein in connection with any other rules or obligations detailed on SportofKings.us including by not limited to the help section, the tc bonus information page, the breeding pages, and the auction pages consitute the entire agreement between any user and SportofKings.us and cannot be modified by any user. The terms and conditions cannot be modified on an individual basis by any person affiliated or claiming affiliation with SportofKings.us. Nothing prevents SportofKings.us from modifying the terms and conditions and posting such modifications.

1.3 Governing Law and Disputes
The terms and conditions will be governed and construed in accordance with the US laws of the physical state of residence of SportofKings.us irrespective of any principles of conflicts of law. By registering and/or particiating you agree that any dispute that cannot be resolved between parties shall be resolved individually without resort to any form of class action. You further agree that any legal action arising from any dispute shall proceed only in the state or federal courts of the physical residence of SportofKings.us only.

1.4 Severability
If any portion of these terms and conditions is deemed void then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of the remaining provisions.

2.1 Eligibility
To open an account and/or participate at SportofKings.us you must meet the following requirements:

You must be 18 years of age or older to enter. Residents of Arizona, Iowa, Louisiana, Montana, North Dakota, Tennessee, Vermont, and Washington may participate but are ineligible to receive back cash prizes. This game is open to legal residents of all other states of the United States, and any other persons residing in any other jurisdiction unless this contest or entry into this contest is prohibited by applicable local law. All federal, state and local laws and regulations apply. This Fantasy tournament contest shall not be used in connection with any form of gambling.

Anyone registering and/or participating at SportofKings.us is subject and responsible for all laws of the state, province, and/or country in which they reside or access SportofKings.us from and are solely responsible for obeying those laws. You agree SportofKings.us cannot be held liable if laws applicable to you restrict or prohibit participation. SportofKings.us makes no respresentations or warranties implicit or explicit as to your legal right to participate at SportofKings.us.

2.5 Monitoring
SportofKings.us reserves the right to monitor the location of anyone registering and/or participating at SportofKings.us. SportofKings.us reserves the right to block access from any jurisiction in which participation is illegal or restricted.

2.6 Additional Information
SportofKings.us has the right to request additional information at any time, some of which may be private, from any user as deemed necessary by SportofKings.us. Participant will have 3 business days to provide any information requested by SportofKings.us and if not provided by participant within 3 business days can result in cancellation of participants account which can include loss of all credits, horses, or anything else of value at SportofKings.us

2.7 Acknowledgement of Proprietary Rights
By registering and/or participating you agree that all information contained on SportofKings.us may be protected in all forms and media by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights, and all rights are owned by SportofKings.us.

2.8 Other Rights
SportofKings.us neither warrants nor represents that your use of materials displayed on SportofKings.us will not infringe rights of third parties.

2.9 Accuracy of Information
SportofKings.us makes no warranties or representations as to the accuracy or timeliness of any information dispayed on the site. SportofKings.us assumes no liability or responsiblity for any errors or omissions in the content of the site.

2.10 Accessibility of Site
SportofKings.us shall not be liable and makes no warranties or representations as to the ability to access the site at any time. SportofKings.us can not be held liable for the inability of any participant to access the site regardless of where the problem is located at.

2.11 Site Content
All names, descriptions, and such contained on this web site are strictly fictitious. Any names and terms used on the site, even those based on real people, are entirely fictional.

2.12 Modification or Discontinuation of Service
SportofKings.us reserves the right to modify or discontinue the game at any time and SportofKings.us shall not be held liable to any member or third party for any loss or damage.

3.1 Partipant Responsibility
It is the responsibility of the participant to adhere to all rules and conditions outlined in the game, including without limitation the general requirement to maintain civility at all times with regard to other players or anything else regarding the game. Of course, any form of cheating is not in the best interest of the game or its participants. SportofKings.us reserves the right to cancel a participant's account at any time, for any such infractions or for anything else SportofKings.us determines to not be in the best interest of the game, or to indicate that the player at issue is not compatible with the game and its participants, and thus is no longer welcome to participate in the game. Cancellation can result in loss of balances, credits, horses, or anything else of real or game value associated with the canceled account. SportofKings.us reserves the right to render forfeited any funds or game property (i.e. horses) from any user or account who obtained the funds/property by any means outside the rules outlined in the game. Such activity, of course, may also lead to complete cancelation of the account, as set forth above.

3.2 Response to Questions, Postings, or Any Other Issues
SportofKings.us always tries to respond to questions, postings, or any other issues in a timely manner but SportofKings.us can not be held liable for speed of response to any question, posting, or issue.

3.3 Forums and Other Particpant Text
Profanity, inappropriate or other offensive language, wagering information (such as odds or part of a transaction), or any other language or postings outside the bounds of polite conversation or otherwise inconsistent with the best interest of the game and its players is strictly prohibited anywhere on the site. Any breach of this standard may lead to immediate and complete cancellation of a participant's account, including without limitation loss of all balances, credits, horses, or anything else of real or game value at SportofKings.us. SportofKings.us reserves the right to review or monitor the forums however it sees fit, from time to time or regularly.

3.4 Views, Opinions, and Postings of Partipants
Views, opinions, and any other postings on SportofKings.us of participants are not necessarily the views or supported by SportofKings.us and SportofKings.us can not be held liable for any such views, opinions, or postings.

3.5 Fees
All fees associated with this game are for entertainment value only. This includes but is not limited to stable fees and nomination fees. Fees are for supplementing costs involved in operating this site and are not put towards prize money offered on this site.

3.6 Termination Due to Inactivity
Participants with verified stables that have not logged in within the last 12 months will be deactivated along with their horses. They can not be reactivated and any credits, horses, or anything else of value will become the property of SportofKings.us.

3.7 Termination Due to Violations
Our policy is that accounts terminated for non-cheating related violations are eligible to withdraw up to the deposited amount minus any previous withdrawals that have been processed. Prior to the processing of any withdrawal request the owner has 30 days to provide identity verification, if not already on file, in compliance with international regulations.

3.8 Refund Policy
Participants have 14 days from their first payment to close their account and request a full refund. After 14 days from a participant's first payment to SportofKings.us only credits still remaining in a participant's account can be refunded.

3.9 Transfer of Ownership
Stables, horses, farms, or anything else not mentioned can not be transferred from one stable to another outside the confines of this game. Owners wishing to disperse items to other stables must do so within the confines of this game through whatever methods are available as part of this game and can only receive payment with methods available inside this game. Third party payments are prohibited. 3.10 Fair Play and Ethics
All players are expected to abide by standard fair play policies and ethics. This covers all aspects of the game but specifically relates to the sale or transfer of horses. Collusion between stables to disadvantage other players is strictly prohibited. Selling or loaning a horse in an effort to circumvent site policies is strictly prohibited and will likely result in an immmediate account suspesenion and or permanent ban.
